If you are under eighteen (18) years of age, you represent and warrant that you have obtained consent from a parent or legal guardian. Waygo does not knowingly collect personal information from children under the age of 18.

Waygo is a travel discovery, comparison, information, and referral platform that assists users in identifying travel-related products and services offered by independent third-party providers.

Waygo may provide access to travel-related content, information, pricing, advertisements, booking links, reviews, tools, software, resources, products, services, and future features through the Service.

Important Disclaimer Regarding Bookings

Waygo does not own, operate, provide, manage, control, sell, supply, or deliver any travel products or services displayed on the platform, including but not limited to:

• Hotels and accommodations
• Flights and air transportation
• Tours and activities
• Car rentals
• Cruises
• Travel packages
• Insurance products
• Transportation services
• Any other third-party travel-related offerings

When you select an offer or booking option displayed through Waygo, you may be redirected to a third-party website, booking engine, travel provider, supplier, online travel agency, or service provider.

Any booking, reservation, purchase, contract, payment, cancellation, modification, refund request, dispute, claim, or customer service matter is solely between you and the applicable third-party provider.

Waygo is not a party to any transaction between users and third-party providers and assumes no responsibility or liability for such transactions.

The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

Waygo makes no guarantee regarding:

• Availability of the Service
• Accuracy of information
• Availability of third-party offers
• Pricing displayed by third parties
• Continued operation of any feature
• Data retention
• Compatibility with any device or browser

Waygo may suspend, discontinue, modify, restrict, or remove any portion of the Service at any time without prior notice or liability.

Where user accounts are made available, you are responsible for maintaining the confidentiality of your login credentials and account information. You accept full responsibility for all activities conducted under your account.

Waygo reserves the right to suspend, restrict, or terminate any account at its sole discretion.

You agree not to:

• Infringe intellectual property rights
• Upload malware, viruses, or malicious code
• Interfere with the operation of the Service
• Scrape, crawl, harvest, or extract data without authorization

Waygo reserves the right to investigate violations and take appropriate legal action.

The Service contains content, pricing, advertisements, booking links, products, services, and information supplied by independent third parties.

Waygo does not control, verify, endorse, guarantee, or assume responsibility for any third-party content or services.

Without limitation, Waygo shall not be responsible for:

• Booking confirmations
• Reservation failures
• Pricing errors
• Changes in availability
• Cancellations
• Refund decisions
• Customer service issues
• Supplier insolvency
• Travel disruptions
• Quality of accommodations
• Airline operations
• Tour operator performance
• Any loss arising from third-party transactions

All dealings with third parties are solely between you and the relevant third-party provider.

To the maximum extent permitted by applicable law, Waygo and Prompt Core Sdn Bhd shall not be liable for any claim, loss, damage, injury, delay, cancellation, overbooking, pricing discrepancy, service failure, refund dispute, travel disruption, personal injury, property damage, or any other issue arising from:

• Third-party travel providers
• Third-party booking platforms
• Hotel operators
• Airlines
• Tour operators
• Car rental companies
• Insurance providers
• Transportation providers
• Any other travel-related supplier

Any legal rights, remedies, refunds, claims, or disputes relating to travel services must be pursued directly against the applicable provider.

Waygo's role is limited to providing information, comparison functionality, and referral access to third-party websites.

“User Content” means any content submitted, uploaded, transmitted, posted, or otherwise made available by you through the Service, including comments, reviews, messages, images, videos, feedback, communications, and other materials.

You retain all ownership rights to your User Content.

By submitting User Content through the Service, you represent and warrant that:

• You own or control all necessary rights to the User Content
• The User Content does not infringe any intellectual property rights, privacy rights, publicity rights, or other rights of any third party
• The User Content does not violate any applicable law or regulation
• The User Content is not false, misleading, defamatory, fraudulent, harmful, or unlawful

Waygo does not claim ownership of any User Content submitted by users.

Waygo may, where necessary for the operation of the Service, display, store, transmit, or remove User Content submitted through the platform. Such actions do not transfer ownership of the User Content to Waygo.

Waygo has no obligation to monitor, review, verify, or moderate User Content but reserves the right to remove or restrict access to any User Content at its sole discretion where it believes such content may violate these Terms, applicable laws, or the rights of any person.

Users remain solely responsible for all User Content they submit, publish, or transmit through the Service.

All content and materials available through the Service, including text, graphics, logos, trademarks, software, databases, images, audio, video, designs, compilations, and other intellectual property, are owned by or licensed to Prompt Core Sdn Bhd and are protected under applicable intellectual property laws.

Except as expressly permitted in these Terms, you may not:

• Modify or create derivative works
• Distribute or sell
• Reverse engineer or decompile
• Exploit any portion of the Service without prior written consent

The “Waygo” name, logos, branding elements, and related marks are proprietary trademarks of Prompt Core Sdn Bhd.

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.

Waygo and Prompt Core Sdn Bhd disclaim all warranties, representations, and conditions of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and availability.

Waygo does not warrant that:

• The Service will be uninterrupted
• The Service will be secure or error-free
• Information displayed through the Service will be accurate or current
• Any defects will be corrected
• Third-party pricing or availability information is accurate

Any reliance on information provided through the Service is entirely at your own risk.

To the fullest extent permitted by law, Prompt Core Sdn Bhd, Waygo, its directors, officers, shareholders, employees, contractors, agents, affiliates, licensors, and partners shall not be liable for any:

• Indirect or consequential damages
• Incidental or special damages
• Exemplary or punitive damages
• Loss of goodwill or loss of data
• Business interruption

This limitation applies regardless of the legal theory under which a claim is brought.

Because Waygo primarily operates as an information and referral platform and does not process or receive payments for third-party travel bookings, users acknowledge that this limitation of liability is reasonable and forms a fundamental basis of these Terms.

You agree to indemnify, defend, and hold harmless Prompt Core Sdn Bhd, Waygo, its directors, officers, employees, contractors, affiliates, and agents from and against any claims, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of applicable laws
• Your infringement of third-party rights

By using the Service, you consent to receiving communications electronically, including notices, disclosures, agreements, and updates.

Electronic communications satisfy any legal requirement that communications be in writing.

Where Waygo directly offers paid services, subscriptions, advertising opportunities, or premium features, applicable fees will be disclosed prior to purchase.

Unless otherwise stated:

• Fees are non-refundable
• Prices may change at any time
• Taxes may apply where required by law

Waygo does not process or control payments made to third-party travel providers.

Your use of the Service is subject to the Waygo Privacy Policy, which is incorporated into these Terms by reference.

Waygo may suspend, restrict, or terminate access to the Service at any time and for any reason without prior notice.

Upon termination:

• Your right to use the Service immediately ceases
• Provisions intended to survive termination shall remain in effect

Waygo shall not be liable for delays or failures resulting from events beyond its reasonable control, including:

• Natural disasters
• Epidemics or pandemics
• Government actions
• Internet outages
• Telecommunications failures
• Cyberattacks
• Labour disputes
• Acts of God
• Wars and riots

These Terms shall be governed by and construed in accordance with the laws of Malaysia.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia.

The parties irrevocably submit to the jurisdiction of the Malaysian courts.

These Terms, together with any policies incorporated by reference, constitute the entire agreement between you and Prompt Core Sdn Bhd regarding your use of the Service and supersede all prior agreements and understandings.

Waygo is owned and operated by Prompt Core Sdn Bhd.
